Supreme Court Dismisses Plea Seeking Arvind Kejriwal’s Removal as Delhi CM

Arrest in Excise Policy Scam Case

The Supreme Court dismissed a plea seeking the removal of Arvind Kejriwal from the post of Chief Minister following his arrest in a money laundering case related to the excise policy scam. The Court emphasized that while it is a matter of propriety, there is no legal right to seek Kejriwal’s removal as Chief Minister due to his arrest. The bench of Justices Sanjiv Khanna and Dipankar Datta stated that it is within the purview of the Delhi Lieutenant Governor to take action if deemed necessary, but the Supreme Court would not interfere in this matter. This decision came in response to a petition filed by Kant Bhati challenging the Delhi High Court’s ruling on April 10, which had dismissed a similar plea.

During the proceedings, the Supreme Court highlighted the distinction between propriety and legal rights in seeking the removal of a Chief Minister under such circumstances. The bench reiterated that while the issue may raise questions of propriety, there is no legal entitlement to demand Kejriwal’s removal as Chief Minister post his arrest. The Court’s stance underscores the importance of differentiating between ethical considerations and legal mandates in matters concerning the removal of an elected official like Kejriwal.

The Supreme Court’s decision to reject the plea aligns with the principle that legal actions and consequences must be guided by established laws and regulations rather than subjective interpretations of propriety. By emphasizing the absence of a legal basis for seeking Kejriwal’s removal, the Court reaffirmed the significance of adhering to legal frameworks and due process in addressing issues related to the tenure of public officials amidst legal proceedings. This ruling underscores the Court’s commitment to upholding the rule of law and ensuring that decisions regarding the status of elected officials are made within the bounds of legal provisions and constitutional principles.
