Supreme Court Halts DGP Sanjay Kundu’s Transfer Amidst Unheard Complaint
In a recent development, the Supreme Court has intervened, putting a stay on the Himachal Pradesh High Court’s order instructing the state government to relocate Director General of Police (DGP) Sanjay Kundu. The decision stemmed from a complaint by a Palampur businessman, highlighting the absence of a fair hearing before the ‘adverse’ directive.
DGP Sanjay Kundu, now designated as principal secretary in the Ayush department, will retain his current position until the high court concludes its assessment of Kundu’s application. The Supreme Court, led by Chief Justice Dhananjaya Y Chandrachud, has urged the high court to deliberate on Kundu’s plea for a recall of the December 26 order within a span of two weeks.
During this period, the stay on Kundu’s transfer remains in effect, emphasizing that no steps should be taken regarding his new posting until the high court reaches a decision. The apex court’s intervention comes in response to Kundu’s petition earlier this week, asserting that the high court’s directive on December 26 was issued without affording him an opportunity to present his side of the case.
