Retired Judge Justice Nirmal Yadav Acquitted in 2008 Corruption Case by Special CBI Court

A special CBI court in Chandigarh has acquitted retired judge Justice Nirmal Yadav in a high-profile corruption case dating back to 2008. The case stemmed from an incident where a cash packet containing ₹15 lakh, allegedly intended for Justice Yadav, was mistakenly delivered to the residence of another judge, Justice Nirmaljit Kaur. At the time of the incident, Justice Yadav was serving as a sitting judge at the Punjab and Haryana High Court.

The verdict was delivered by Special CBI Judge Alka Malik, who also acquitted the other accused involved in the case. Following the judgment, Justice Yadav asserted her innocence, stating that she had not committed any crime and that no incriminating evidence had emerged against her throughout the trial.

The case dates back to August 13, 2008, when a clerk at Justice Kaur’s residence accepted a packet containing ₹15 lakh in cash. It was later revealed that the cash was allegedly meant for Justice Yadav but was mistakenly delivered to Justice Kaur due to the similarity in their names. Reacting swiftly, Justice Kaur informed the then Chief Justice of the Punjab and Haryana High Court and the Chandigarh Police. This led to the registration of a First Information Report (FIR) on August 16, 2008. However, within ten days, the case was transferred to the Central Bureau of Investigation (CBI) by the then UT Administrator, General (Retd) SF Rodrigues, and a fresh FIR was filed on August 28, 2008.

Investigations by the CBI revealed that the money was delivered by a clerk working for former Haryana Additional Advocate General Sanjeev Bansal. Allegedly, after realizing the mistaken delivery, Bansal contacted Justice Kaur and claimed that the cash was actually meant for someone named Nirmal Singh.

As the case progressed, in January 2009, the CBI sought permission to prosecute Justice Yadav. The Punjab and Haryana High Court granted the sanction for prosecution in November 2010. Justice Yadav challenged this decision, but her petition was unsuccessful. Subsequently, in March 2011, the President of India granted approval for the prosecution, paving the way for the CBI to file a chargesheet the same month.

With this latest verdict, Justice Nirmal Yadav has been cleared of all charges, bringing an end to the long-standing legal battle.
